June 2008

On June 3, 2008, Jim Daley will speak on the topic of the “International Privacy, Discovery and Regulatory Retention – a Legal and Operational Review” at the Compliance Governance & Oversight Council conference in New York. The presentation will focus on the constraints that conflicting regulations between countries impact e-records discovery and transfer.

On June 4, 2008, Lori Wagner will be presenting a workshop on electronic discovery at the National Disability Rights Network’s 2008 P&A / CAP Annual Meeting in New Orleans. The National Disability Rights Network (NDRN) is the nonprofit membership organization for the federally mandated Protection and Advocacy (P&A) Systems and Client Assistance Programs (CAP) for individuals with disabilities. On June 17th, Jim Daley will speak on the issue of “Why Digital Information is Different” at the “E-Discovery: An A to Z Workshop” in St. Louis, sponsored by West Legalworks. Jim’s talk will focus on the impact of the new federal e-discovery rule amendments on corporate records management, litigation readiness and e-discovery.

On June 18, 2008, Jim Daley will speak alongside Hon. David J. Waxse on the issues of “Ethical Considerations in Electronic Discovery,” and “Guidelines for Discovery of ESI” at the Electronic Discovery and Document Management Conference in Kansas City, MO sponsored by Lorman Education Services. Jim and Judge Waxse will discuss ethical considerations in e-discovery, and how to successfully navigate the Kansas E-Discovery Guidelines and Rule 26 Meet & Confer disclosure requirements.

 

May 2008

Jonathan Redgrave and M. James Daley will both be speaking at the 2008 Managing Electronic Records ("MER") Conference at the Westin Michigan Avenue Hotel in Chicago, Illinois held May 19-21, 2008. Jonathan with be speaking on "ERM Case Law: The latest News, Trends and Issues" with Carol Eoannou, Esq. of BNA, Inc. and "Assessing the Sedona ERM Guidelines: Influence on 2006 FRCP, Impact on Judicial Decisions and Specifics of Recent Changes" with Ken Withers, Esq. of the Sedona Conference, and Tom Allman, Esq., former General Counsel of BASF Corporation. Jim will be presenting with Dick Fisher and Carol Stainbrook of Cohasset Associates, Inc. on "Case Study: Data Mapping and the FRCP – 18 months into the New Rules." Jim will also be on a panel entitled “What the MER Headlights See: Insights on Four Future ERM Issues." Jim will also be presenting a Pre-Conference Tutorial with Laurie Fischer and Dick Fisher of Cohasset Associates entitled "E-mail Management – Today’s Legal, Operational and Technical Challenges and Opportunities."

On May 29-31, 2008, Jim Daley will be presenting on the topic of “Cross-Border Conflicts Relating to Mass Discovery, Including Foreign Data, Privacy, and Protection Regulations,” at the ALI-ABA Course of Study in Mass Litigation in Charleston, South Carolina.

 

April 2008

On April 3, 2008, Lori Wagner spoke at the 2008 Florida Gulf Coast ARMA Chapter Educational Seminar at the Safety Harbor Spa and Resort in Safety Harbor, Florida. The Seminar theme was “Elevating Records Management from the Basement to the Board Room”. Lori’s presentation is entitled “Sedona Guidelines.-Riding the Electronic Discovery Train to get Electronic Information Management on Track” and she also participated in an open panel discussion with other speakers from the conference at the end of the day. Lori, along with Jonathan Redgrave and Chuck Ragan, was a co-editor-in-chief of The Sedona Guidelines. March 2008

On March 20, 2008, from noon-1:00 p.m. Lori Wagner spoke at the Hennepin County Bar Association’s Corporate Counsel Section program entitled “Attacking the Castle: How Records Management Programs Survive Legal Events.” Lori discussed the important elements of defensible corporate records and information management programs and the warning signs to look for to determine whether your program might be subject to attack.See http://www.hcba.org/intus/Event3/event.asp for more information.

Jonathan Redgrave was quoted in an online Federal Computer Week (fcw.com) article on December 17, 2007, entitled “Hot or not: Congress failed to make a mark: But policies for better information sharing and e-discovery were positive advances.” In discussing the readiness of companies and government agencies for the December 2006 Federal Rules of Civil Procedure amendments, Jonathan said that “The reality is that you have varying levels of compliance and awareness throughout the federal government…The biggest problem that we’ve seen with agencies is that they don’t have the right people or haven’t done their homework to prepare before litigation.”

 

Jonathan Redgrave was quoted in a March 5, 2008 article in Corporate Counsel published on law.com. Entitled “Qualcomm’s Hard-Learned Lesson”, the article discusses lessons learned in Qualcomm’s legal battle with Broadcom Corp. over e-discovery issues. Jonathan specifically commented that “[t]he more contentious discovery becomes, the bigger the risk to your credibility…You want to develop trust. Because when you have a trust relationship and problems happen, the judge may give you grace and not hit you with sanctions.”

Jonathan Redgrave and M. James Daley were both panelists at The Sedona Conference Institute’s “Second Annual Program on Getting Ahead of the eDiscovery Curve: Strategies to Reduce Costs & Meet Judicial Expectations” held at the Westin Horton Plaza in San Diego California on March 13-14, 2008. Jonathan was a panelist on three sessions entitled “Update, The Sedona Principles, Second Edition & the New Rules”, “Effective Preparation by a Producing Party for a Rule 26(f) Conference”, and “Vignettes from a Rule 26(f) Conference/Best Practice Recommendations.” Jim was also a panelist on three sessions entitled “New Roles & New Teams to Meet ESI Production Obligations/Expectations”, “Search & Information Retrieval Methods/Best Practices”, and “New Issues Under the New Rules.”

February 2008

Lori Wagner spoke at LegalTech New York 2008 which was held in New York City on February 5-7, 2008. The presentation was entitled “E-discovery Update: 2007 Legal Developments and Technology Trends for The New Year.” Topics discussed include an overview of the Federal Rules of Civil Procedure Amendments, “best practices” in collecting, filtering, preserving & reviewing electronically stored information as well as what can be anticipated for e-discovery in 2008.

Lori Ann Wagner and Kate Chaffee spoke at the Microsoft E-Discovery Summit in Bloomington, MN on February 20, 2008. The Summit was aimed to provide people with information about the new federal e-discovery requirements to help them avoid sanctions. Lori and Kate discussed the legal impact of the amendments in a presentation entitled “What is E-Discovery?” For more information click here.

January 2008

In January 2008, Charles Ragan participated in the Juris Seminar on E-disclosure at the Harvard Club in New York City. This seminar addressed the extent of electronically stored information in transactions, storage and retrieval strategies, forensic searches, and proactive organization and planning.

On January 17 & 18, 2007, Jim Daley spoke on “Electronic Discovery and Records Management: New Litigation Challenges.” at New York’s Fordham Law School. The seminar, sponsored by ALI-ABA, offered a comprehensive examination of the admissibility of electronic evidence, spoliation and sanctions, strategies for document retention and elimination and ethical considerations in electronic discovery.

On January 24, 2008, Jonathan Redgrave spoke at the AIPLA 2008 Mid-Winter Institute in Phoenix, Arizona. The Institute is entitled “IP Practice Today: Techniques for Getting the Job DONE.” Jonathan’s lecture was entitled “Ethical Considerations in Electronic Discovery Matters.” For more information click here.

On Thursday, January 27, 2008, Jim Daley was be a roundtable panelist at the 4th Annual CGOC E-Discovery Summit in Palm Springs, California on “Envisioning Discovery Circa 2010.” Jim was joined by Kathy Harris, SVP of Merrill Lynch, Ian Katz, Senior Counsel at CIBC and Tom Lahiff, former Associate General Counsel at Citigroup. The panel provided valuable insights as to emerging issues in e-discovery, electronic information management and the use of outsourcing.

On January 31, 2008, Chuck Ragan appeared at a seminar in New York City entitled Electronic Evidence and Disclosure in International Arbitration, and leading a panel of internationally renowned arbitrators and technologists who discussed “Whither E-disclosure in international arbitration?”

Charles Ragan was appointed by the International Institute for Conflict Prevention and Resolution (“CPR”) to serve on the CPR E-Discovery Panel, recently created by CPR as part of their Specialized Panels, which were created because disputes in some areas of law may be more readily resolved by neutrals who have substantial knowledge of the industry or practice area.

November 2007

On November 27, 2007, Jonathan Redgrave participated in a Sedona Conference Webinar entitled “Voices from the Desert.” The webinar was a panel discussion, and focused on looking at the “state of e-discovery” a year after the amendments to the Federal Rules of Civil Procedure took effect, the updated version of the Sedona Principles, and a review of Sedona Working Group One’s 2007 Annual Meeting.

On Friday, November 16, 2007, M. James Daley was a panelist at the 4th Annual 2007 Georgetown University Law Center CLE - Advanced E-Discovery Institute: The Revised Federal Rules – A Year Later. Jim was on the panel entitled "Electronic Document Review: Why Best Practices for Traditional Paper View Doesn’t Translate to ESI." This panel discussed several topics relating to best practices for electronic document review and production.

On November 15 & 16, 2007, Jonathan Redgrave spoke at the 4th Annual 2007 Georgetown University Law Center CLE – Advanced E-Discovery Institute. He moderated the panel “The Federal Rules Amendments a Year Later: A Judicial Perspective.” This panel focused on judges’ perspectives of how the rules are working, and what they view “as best practices and not so best practices.” He also participated in a panel entitled “Practical Advice Regarding the ‘Discovery’ in E-Discovery.” This panel discussed preparation for depositions and also requirements for Rules 26(a), 33 and 34.

On November 15, 2007, Kenneth Prine spoke as part of an e-discovery panel at the 2007 Labor & Employment Law Institute in Minneapolis, sponsored by Minnesota CLE.

On Wednesday, November 14, 2007, M. James Daley conducted an Audio Seminar. sponsored by the Legal Publishing Group of Strafford Publications entitled "E-Discovery: Search and Information Retrieval Strategies, Identifying and Collecting Electronic Information under the New Federal Rules." The seminar included discussion on best practices for search and retrieval of the burgeoning amount of electronic information available on hard drives as well as newer technologies such as flash drives, as well as tips for effectively communicating with your IT department. Continuing to act as leaders on various projects connected to the Sedona Working Group on Electronic Document Retention and Production (“WG1”), all four founding partners of RDRW attended the annual meeting in Hilton Head, SC on November 8-9, 2007. The meeting involved discussion of the effects of the ESI amendments to the Federal Rules of Civil Procedure and work product that various 2007 special teams have been developing in the areas of: production of ESI by non-parties; best practices in e-discovery collection, review and production; protection of privilege in high-volume ESI productions; ESI authenticity; legal holds; preservation and disclosure of ESI deemed not reasonably accessible; and search and retrieval sciences. The meeting also featured a judicial roundtable and Q&A session.

October 2007

On October 9, 2007, Lori Wagner was a panelist in a Mini-Sedona Conference at ARMA International’s 52nd annual conference and expo in Baltimore, MD. The Mini-Sedona took place from 8:00-11:30 a.m. and consisted of half formal presentations by the panelists and half interactive dialogue with the audience(which was to 70 people). On October 17, 2007, M. James Daley presented a national webinar entitled “Lost in Translation – Navigating the Minefield of International E-Discovery” sponsored by Lumen Legal. The discussion included: discoverability of electronic information held by foreign parents of US corporations; handling US court orders compelling discovery of electronic information stored in foreign jurisdictions; minimizing the risk of foreign "dawn raids" on electronic information; understanding and applying the US Safe Harbor framework; and practical Approaches to avoid international data privacy and e-discovery risks and costs.

Lori Wagner participated in a panel discussion of electronic discovery counsel and vendors at the Twin Cities E-Discovery Forum on October 23, 2007. The focus of the presentation, to Twin Cities in-house e-discovery counsel and support personnel, was “The Federal Rule Amendment: Lessons learned and ‘in-the-trenches’ experiences.”

On October 24, 2007, Chuck Ragan participated in the University of Texas CLE Electronic Discovery Workshop organized by Craig Ball and was held at the Four Seasons Hotel in Austin, Texas. Chuck was the lead presenter on “Litigation Readiness,” and participated in “challenge panels” on “E-Discovery Jeopardy”, and “Preservation Priorities”.

M. James Daley spoke at the Masters Conference for Legal Professionals at the Ronald Reagan Center in Washington, D.C. on October 25 & 26, 2007. The conference was entitled “E-landscape in the FRCP Fallout” and is the second annual Masters Conference series on E-Discovery.

On October 30, 2007, Jonathan Redgrave participated in the 6th Annual Law Firm General Counsels’ Forum at the Westin Times Square in New York City. September 2007

Jonathan Redgrave and Lori Wagner were both featured speakers at the 24th International Records Management Association of Australia ("RMAA") Convention from September 9-13, 2007 in Wellington, New Zealand. The convention's theme was "Influence with Integrity" and included program days focused on influencing society, organizations and the records management profession, as well as workshops on a variety of topics, including influencing senior management. Jonathan was a keynote speaker at the convention and presented a discussion of "The US Culture of Litigation and the Unrelenting Search for Evidence." Click here for a preview. In addition, Lori and Jonathan served as team captains in the convention-closing debate over the question “Are records management standard bunk?” and conducted workshops in Wellington, NZ and Brisbane and Sydney, Australia concerning records management and United States litigation issues. On September 11 & 12, 2007, M. James Daley was a moderator and panelist for a Professional Education Broadcast Network National Audiocast entitled "Digital Evidence: New Rules and Recent Developments from the Courts."

M. James Daley is a Senior Editor of "The Sedona Conference ® Best Practices Commentary on the Use of Search & Information Retrieval Methods in E-Discovery," published in the Fall 2007 edition of The Sedona Conference Journal. The commentary is a project of The Sedona Conference ® Working Group on Best Practices for Document Retention and Production (WG1), Search & Retrieval Sciences Special Project Team. On Thursday September 27th, Andrew Cosgrove spoke at the 2007 Midwest Intellectual Property Institute in Minneapolis, MN. He addressed a breakout session entitled “How to Improve Your Company’s IP-Related Records and Information Management in Light of the New E-Discovery Rules.” This breakout session addressed issues and provided recommendations for businesses regarding policies and procedures for handling electronic information and intellectual property work. August 2007

On August 14, 2007, Jonathan Redgrave spoke at the IT Quarterly Forum sponsored by General Services Administration’s Office of Technology Strategy and CIO Council’s IT Workforce Committee. The Forum was held in Washington, D.C. He participated in the panel “Who’s Afraid of E-Discovery? Cautionary Tales Every CIO and Every IT Person Needs to Know to Survive Into FY2008, and Beyond.” Also participating on this panel were panel chair Jason R. Baron, Director of Litigation at the National Archives and Records Administration, and Rachel Spector, Assistant Solicitor at the U.S. Department of Interior. This panel focused on how both CIOs and IT personnel can best control their electronic information and communicate with their counsel and managers.

June 2007

On June 19, 2007, Jonathan Redgrave spoke at the Legal EHR Conference: Ensuring Health Record Integrity, held at the Windham Chicago Hotel in Chicago, Illinois. Jonathan’s presentation was entitled “The New e-Discovery Rule and Implications.” He addressed key components of the e-discovery rule, issues, challenges and implementation strategies. At the ARMA conference in Kansas City, MO June 25-26 entitled "E-Discovery & Beyond: Harnessing the Power of Collaboration", Jim Daley spoke on the impact of the new federal rules of civil procedure. Among other items, Mr. Daley elaborated on: creating a plan to provide a description, organized by category and location, of all electronically stored information for discovery, identifying mandated requirements for various organizations, identifying timely response requirements based on who it concerns and what is required and designing a retention policy that will meet the definition of "routine, good-faith." M. James Daley, partner at Redgrave Daley Ragan and Wagner LLP, presented a series of webinars in which he shared practical knowledge about e-discovery for firms and corporations alike. The first of these webinars concentrated on risks and costs. During All-In? Practical Approaches for Beating the "No-Limit" Game of E-Discovery Risk and Cost, Daley expounded on: 1) The impact of the new federal e-discovery rules on e-discovery risks and costs, 2) How to reliably assess the "all-in" e-discovery risks and costs to an organization, 3) How IT can help lawyers prepare to avoid e-discovery risks and costs, and 4) Areas of potential risk and cost reduction throughout the entire legal information management life-cycle. As Daley said, "It's important to look at total cost of ownership and all-in costs when you're making decisions about e-discovery risk and costs. Often we overlook certain parts of those costs, which can lead to bad decisions and results." Daley walked through a general all-in cost assessment methodology and identify cost components at a high-level to develop a common framework for understanding. May 2007

M. James Daley participated in the 15th National Conference on Managing Electronic Records – MER 2007 on May 21-23 in Chicago, Illinois. His pre-conference seminar was entitled “E-mail Management…or Mis-Management?? An Incisive and Expert Examination – from the Legal, Operational and Technical Perspectives.” The seminar dealt with specific legal concerns, trends in the current approaches of attorneys and judges when dealing with email both in pre-trial meetings as well as during the course of a trail, and possible future trends. Also addressed was whether the legal concerns are adequately being addressed by organizations today, as well as current trends, from a records management and operational perspective, for the management of email. Recommendations for email management, from a non-technical perspective, were also provided.

On May 21, 2007, Jonathan Redgrave spoke at the National Managing Electronic Records (MER) Conference held at the Westin Hotel in Chicago, Illinois. Jonathan co-presented a session entitled “ERM Case Law: The Latest News, Trends and Issues” with Carol L. Eoannou, Managing Editor of Digital Discovery & e-Evidence (BNA, Inc.) On May 30, Jonathan Redgrave was a panelist for a BNA live Audioconference entitled "Electronic Records Management Pioneers Share Their Tips on What Works, What's Practical, and What Not to Do." April 2007

Jonathan Redgrave spoke during the Texas Bar CLE "Electronic Discovery and Digital Evidence Institute" on April 18, 2007 at the Hilton Houston Westchase in Houston, TX. He gave the opening keynote speech, titled "The Path to Production," as well as served as the moderator for the session "Managing the Team: Vendor Selection and Due Diligence Project Management Processing and Review Strategies." On April 20, 2007, Jim Daley participated in a mock discovery hearing with The Honorable Paul W. Grimm, United States District Court for the District of Maryland, Baltimore, Maryland and Matthew M. Neumeier of Jenner & Block LLP, Chicago, Illinois. This presentation was part of the Electronic Discovery Seminar presented by the Defense Research Institute's Electronic Discovery Committee, which was held on April 19-20, 2007 at the Renaissance Hotel in Washington, D.C. On April 24, Jonathan Redgrave spoke during the National Workshop for Magistrate Judges I, held during April 23-25, 2007 in Austin, TX. He co-presented with the Hon. James Francis IV of the Southern District of New York during the session titled "No Judge Left Behind: A Report Card on the E-Discovery Rules."

M. James Daley participated as a panelist in several sessions during eDiscovery Day in Las Vegas, Nevada, April 24, 2007 hosted by CA World. Jonathan Redgrave was a panelist during the Future of Product Litigation conference, held on April 26-27, 2007 in Chicago, Illinois hosted by Product Liability Advisory Council, Inc. ("PLAC"). The topic was "Electronic Discovery: Latest need-to-know update on e-discovery and FRCP amendments – what's working, what's not". He spoke about the technical concepts involved in e-discovery, including significant case developments, trends and emerging issues, and the status of the Sedona Principles.

March 2007

Jonathan Redgrave participated in a panel discussion regarding electronic discovery on March 21, 2007 at the Workshop for Judges of the United States Court of Appeals for the Fourth Circuit in Charleston, South Carolina. The workshop was organized by the Federal Judicial Center. Other members of the panel were Judge Shira Scheindlin of the Southern District of New York and Judge Paul Grimm of the District of Maryland.

M. James Daley participated in a two day institute in March sponsored by The Sedona Conference Institute and ARMA International in Memphis, TN entitled "Getting Ahead of the eDiscovery Curve: Strategies for Companies and Their Counsel to Reduce Costs and Meet Judicial Expectations." He participated in three panels: Changing Expectations: Changing Roles & New Teams, Developing the Litigation Response Strategy; Mock Preparation for a Rule 26(f) Conference, and Testing the Litigation Response: Mock Rule 26(f) meeting with Opposing Counsel. Jonathan Redgrave participated in a panel discussion "E-Discovery Rules Have Changed, What About You, Your Company & Your Clients?" on February 16, 2007 at the ABA Section of Litigation mid-year meeting at Amelia Island Plantation in Amelia Island, Florida. January 2007

On January 12, 2007, Jim Daley and Paul Robertson lead a meeting of the Steering Committee of The Sedona Conference International Working Group on the Disclosure, Management, and Protection of Electronically Stored Information (“WG9”) in London, England.  This was a mid-year meeting, and provided the Steering Committee to review the status of drafts being prepared by the group for publication in the spring.  For more information regarding the Working Group Series, click here.

Paul Robertson acted as a U.S. representative for the inaugural meeting of the Sedona Conference England & Wales.  The meeting took place early January 2007 and focused on matters related to the composition, mission, and desired work product of the new organization.

Lori Wagner co-presented the web-cast "E-Discovery Update: 2006 Legal Developments and Technology Trends for the New Year" with Michele Lange, Esq. of Kroll Ontrack on Tuesday, January 16th at 12:00 noon CDT. The program reviewed the 2006 events that revolutionized e-discovery law and practice. The program discussed key impacts of the FRCP e-discovery amendments and proposed changes to the Federal Rules of Evidence affecting the discovery of privileged information, as well as significant e-discovery cases, best practices for using cost and time-saving topic review tools and upcoming technologies for early case assessment and discovery strategy. Paul Robertson participated in a FIOS webinar titled "International Electronic Information Management, Discovery, and Disclosure," on January 24 at 12:00 p.m. (CST). The webinar was broadcasted internationally. There was a report on the efforts of the Sedona Conference International Working Group on the Disclosure, Management, and Protection of Electronically Stored Information, which Paul chairs. December 2006

On December 1, 2006, Jim Daley participated in an interactive audio event entitled "Migrating from e-Discovery to Effective e-Records Management: Lessons Learned & Remaining Obstacles." The program was designed for records managers and attorneys involved in records management issues and sought to address how organizations can implement effective electronic records management systems based on the current understanding of the nature of electronically stored information to answer both day-to-day business demands and the demands of litigation. On December 12, 2006, Paul Robertson spoke in Boston at "E-Discovery under the New Federal Rule: Tips, Tactics & Strategies," a conference co-sponsored by the Federal Bar Association and by host Suffolk University Law School. Paul discussed the impact of the new Federal Rules of Civil Procedure on practices related to the preservation, protection, and production of electronically stored information. November 2006

All five RDRW partners and several employees attended the annual meeting of the Sedona Working Group on Electronic Document Retention and Production in La Jolla, CA on November 2-3.  Jonathan Redgrave chaired the meeting which dealt with proposed updating to The Sedona Principles and The Sedona Guidelines, along with work product that various, 2006 special teams have been working on in the areas of e-mail archiving, litigation hold, legacy data and search and retrieval sciences.  The meeting was noteworthy due to the attendance of 10 federal jurists as observers, who provided significant insight into the application of the federal rule amendments from their perspectives.

Lori Wagner presented "Federal Rules Changes: An Overview of the Practical Impacts for Legal Teams" at Kroll Ontrack's Advanced Electronic Discovery Certification Course on November 13, 2006. On November 13, 2006 Laura Gilbert served as guest lecturer for Employment Law and Labor Union law classes at Hamline University School of Law.  Laura spoke on trends and emerging case law in workplace privacy in both public and private sector contexts.

Lori Wagner presented "ESI Twin Cities: Are U Ready?" at the Olsen Thielen Technologies, Inc. Summit on November 14, 2006, at the DoubleTree Park Place Hotel, St. Louis Park, MN. Jonathan Redgrave attended a meeting of the Advisory Committee for the Electronic Records Archives Program of the National Archives and Records Administration in Washington, D.C. on November 15 and 16, 2006. Jonathan is a member of the Advisory Committee and the only attorney to serve in this capacity.

Paul Robertson and Jonathan Redgrave were both on the faculty of the Georgetown Advanced E-Discovery Institute, November 16-17, 2006 in Washington, DC.  Paul was part of a panel discussion entitled “Collecting Electronically Stored Information.”  In addition to co-chairing the program, Jonathan moderated a panel entitled “The Preservation Problem: Sanctions.”

October 2006

On October 5, 2006 Jonathan Redgrave spoke at a BNA Conference titled "E-Discovery: How to Practice Under the New Amendments" at the Westin Embassy Row Hotel in Washington DC. The conference presented a timely and authoritative briefing on how to prepare for the new Federal Rules of Civil Procedure relating to electronically stored information set to become effective December 1, 2006.

Laura Gilbert spoke at the Computer and Technology Law Institute on October 17, 2006 in Minneapolis, MN. The presentation was entitled "Your Practical Privacy Primer: Liability Hotspots and Solutions." Joining Laura was Jay Cline, formerly Data Privacy Officer for Carlson Companies and currently President of Minnesota Privacy Consultants. The presentation toured through the key laws governing data privacy including insights about today's liability hotspots, consequences for noncompliance, emerging corporate solutions and more.

Jim Daley and Paul Robertson participated in the ALI-ABA program entitled "Electronic Records Management and Digital Discovery." On Wednesday, September 20th, 2006, M. James Daley co-presented a webcast entitled "Making the Case for E-mail Archiving & Litigation Readiness Best Practices for E-mail Retention and Management." Together with David Campbell and Robert Markham, Jim addressed the complex requirements for managing electronic records including e-mail, in specific the technical capabilities and management strategies of e-mail archiving.

On September 15, 2006 Jonathan Redgrave chaired an event titled "Fundamentals of Ediscovery and the New Rules" at Northwestern University School of Law in Chicago, IL. James Daley and Paul Robertson attended the second annual meeting of The International Electronic Information Management, Discovery and Disclosure Sedona Conference working group in Madrid, Spain in September, 2006.  Paul served as Program Chair for this WG6 Event.  The group is working to finalize a Global Survey in advance of working on guidelines and best practices recommendations.

August 2006

On August 5th, Jonathan Redgrave participated in a panel presentation at the 2006 American Bar Association Annual Meeting in Honolulu, Hawaii. The panel introduced the new E-Discovery Amendments to the Federal Rules of Civil Procedure which are set to go into effect December 1st, 2006. As part of the discussion, the panelists addressed "Best Practices" in dealing with electronically stored information. Jonathan was joined by Dawn Bergin, James Belanger, Mia Mazza and Steven R. Rogers.

July 2006

On July 19, 2006, Jim Daley participated in a panel presentation entitled "Hot Issues in Records Management & E-Discovery." Participants shared perspectives on unique challenges, best practices and applicable law and offered suggestions on technology from multidisciplinary backgrounds. Jim was joined by Kevin Esposito, James Michalowica, Thomas E. Stevens, Tom Opsitnick, Peter Hennigan and Karin Roberts.

June 2006

On June 13, 2006, Lori Wagner participated in a panel on spoliation and the new electronic discovery rules at the 32nd Annual Federal Practice Seminar at the Hyatt Regency in Minneapolis, MN. Lori was joined by several local practitioners and U.S. Magistrate Judge Susan Richard Nelson (D. Minn.).

On June 16, 2006, Jonathan Redgrave and Lori Wagner co-presented a program entitled "E-Discovery for Smarties" at the Minnesota Attorney General's 19th Annual Technology and the Law Seminar at the O'Shaughenessy Educational Center Auditorium, St. Thomas University, St. Paul, MN.

On June 30, 2006, Jonathan Redgrave spoke at the Sixth Annual D. Brook Bartlett Lecture Series in the Charles Evans Whittaker Courthouse in Kansas City, MO. On May 11, 2006, Chuck Ragan spoke on the topic "'ESI' is Coming in Less than Nine Months: Do You Know Where Your Data Is?" at the 28th Annual Corporate Counsel Institute CLE, Cityplace Conference Center, Dallas, Texas on E-Discovery and Record Preservation.

On May 11-12, 2006, Jonathan Redgrave, Jim Daley and Lori Wagner participated in the Mid-Year meeting of the Sedona Conference Working Group on Electronic Records Retention & Production ("WG1") at the Royal Palm Resort in Phoenix, Arizona. Jonathan served as chair for the meeting and currently serves as co-chair of the small group addressing Legacy Data, of which Lori is a member. Jim serves as co-chair of the Sedona Conference Search & Retrieval Sciences Project Team. Chuck Ragan is a member of the Legal Hold Team.

On May 17-18, 2006, Lori Wagner was a panelist at the IQPC seminar "Document Retention & Electronic Discovery – Practical Solutions and Best Practices" at the St. Andrews Club & Conference Center in Toronto, Ontario. Lori's panel was entitled "Latest Trends in the U.S. – Lessons Learned," and included the Hon. On May 18-20, 2006, Jim Daley was a featured speaker at the ALI-ABA program entitled "Electronic Records Management and Digital Discovery Practical Considerations for Legal, Technical, and Operational Success." On May 22-24, 2006, Jonathan Redgrave and Jim Daley spoke at the Annual MER Conference in Chicago, Illinois. Jonathan and Jim gave a joint presentation on "The ERM Impact of the New Federal Rules of Civil Procedure: What You Need to Do to be Ready." Along with Carol Eoannou of Pike & Fischer, Jonathan discussed the implications of case law on electronic document storage in a session titled "ERM Case Law: The Latest News, Trends and Issues." Jim joined a representative from DuPont in a presentation on "Taking ERM to a New Level: Embedding Records Management into Business Processes," and participated in a Town Meeting panel discussion of the "Legal, Technical and Operational Feedback to Microsoft regarding the New Office 12," which assessed the vendor and user implications of Microsoft's new operating system software release from technical, operational and legal points of view.

On May 25-26, 2006, Jonathan Redgrave facilitated the inaugural meeting of WG:Sedona Canada. This working group is part of The Sedona Conference® Working Group Series, and was formed to focus on Canadian best practices for electronic document retention and production. January 2006

On January 11, 2006, Jonathan Redgrave moderated a telephone conference seminar titled "Privilege in Peril: Judges' Perspectives on Privilege Problems Associated With Electronically Stored Information." The conference focused on Hopson v. The Mayor and City Council of Baltimore and its impact on modern discovery practice and electronically stored information. The program was hosted by Pike and Fischer and featured panelists Magistrate Judge Paul W. Grimm (D. Md); Magistrate Judge John M. Facciola (D. D.C.) and Magistrate Judge Ronald J. Hedges (D. N.J.).

On January 30, 2006, Jonathan Redgrave served as a panelist for The Canadian Institute's
E-Document Management & Discovery Conference at The Four Seasons Hotel in Toronto, Canada. He was the opening speaker for the conference on the topic of "E-Discovery American Style: Examining the Latest Trends in Electronic Document Production South of the Border."
